Section 3 – Data Security

We use up-to-date technical measures to guarantee the security of data, especially in order to protect your personal data against risks in the case of data transfers and against being disclosed to or accessed by third parties. These measures are adapted in accordance with the current state of the art in terms of technology.

Section 4 – Collection of Personal Data in the Case of Informational Use

(1) When you use the website solely for informational purposes, namely when you do not sign up, register or provide us with information in order to use the website, we will not collect any personal data with the exception of data that your browser transmits in order to enable you to visit the website. These data are:

  • the time and date of your request
  • the time-zone difference to Greenwich Mean Time (GMT)
  • the content of your request (the concrete web page requested)

  • the data volume transmitted

  1. Use of the functions of our website

(1) Alongside use of our website as a pure source of information, we also offer a number of different services that you can use if interested. In order to use these services, you normally need to submit further personal data that we use to provide the service in question. If you have the option of providing additional voluntary data, these fields will be marked appropriately.

(2) If you contact the service provider by e-mail or via the contact form, we will store your e-mail address and, if provided, your name and telephone number in order to answer your questions.

  1. Disclosure of data to third parties

(1) We may disclose your personal data to third parties if we offer interactive promotions, competitions, bookings or conclusions of contract in cooperation with a third-party provider. In this case, you will be separately informed that your data will be disclosed to third parties before they are transferred.

(2) We partly use the services of external providers to process your data. We carefully select these providers and commission them in writing. They are bound to our instructions and checked by our company on a regular basis. The providers do not disclose these data to third parties. If these providers are based in [the USA], we will inform you of this in connection with the functions in question. These data processing activities also comply with the valid legal situation and these providers in particular participate in the Safe Harbor programme.

  1. Use of the blog functions

(1) You can write public comments in our blog, in which we publish various articles on relevant subject areas. When you submit a comment, it will be published under the article in question, together with the username (or, where applicable, nickname) that you have entered. You can choose whether or not you want to provide your website address. When you submit a comment, we internally save your e-mail address and IP address, the latter of which is automatically deleted. We do so because we may be liable for the publication of illegal content under certain circumstances. Comments are not checked before publication. We do, however, monitor comments at random and are authorised to delete them if they potentially contain illegal content.

(2) When writing a comment, you can click on a checkbox to use an e-mail service that will inform you if another user publishes a comment on the article in question. This service uses the so-called double opt-in method, meaning that you will receive an e-mail in which you must confirm that you are the owner of the e-mail address and want to receive the notifications requested. You can cancel these notifications at any time by clicking on the link contained in the e-mail. Your personal data will then be deleted after the storage period has expired.

(3) This comment function uses the Disqus plug-in provided by the company Big Head Labs, Inc., www.disqus.com (hereinafter referred to as "Disqus"). This plug-in not only enables you to submit a comment as a guest without registering, but also to submit comments on all websites that use Disqus as a registered user or by logging in with your Facebook (via Facebook Connect), Twitter, Yahoo or OpenID account. When you log in via the providers listed above, these providers will also store and use your data. To find out more, please refer to the privacy policy regulations of the provider concerned. Disqus provides us with the data shared in the comment form or, where applicable, by the third-party providers.   1. Use of our webshop

(1) If you want to order an item from our webshop, you can choose whether you only want to enter the data required for your order for this particular order or want to set up a customer account in which your data will be saved for future purchases. If you do not set up a customer account, we will store your data for the purpose of execution of the contract and delete them as soon as we are no longer legally obliged to store them. Mandatory details required for the implementation of contracts are marked separately and the provision of further details is optional. When you set up an account under "My account", the data that you provide are stored but can be revoked at any time. You can delete your account in the customer area of the website at any time. When you set up a customer account, you will not receive any advertisements from us via e-mail or post. We will, however, inform you about technical issues where applicable.

(2) We use the data that you provide for the processing of your order. To process your order, we pass on your address details to a commissioned shipping company and, where applicable, pass on your payment details to our main bank. We then delete these data once the contract has been executed and our obligations to retain data according to fiscal and business law have expired.

(3) The order process is encrypted using SSL technology in order to prevent unauthorised access to your personal data, especially financial data, by third parties.

  1. Use of our portal

(1) If you want to use our portal, you will need to register by providing your e-mail address and a password and username of your choice. You are not obligated to use your real name and can therefore choose to use a nickname if desired. When you register to use the portal, we use the so-called double opt-in method, meaning that your registration will not be complete until you confirm it by clicking on the corresponding link in the confirmation e-mail that you will receive after submitting your registration. If you do not confirm your registration shortly after receiving the e-mail, it will be automatically deleted from our database.

(2) When you use our portal, we store your required data required for the purpose of execution of the contract, including information regarding your payment method. We also store the data you provide voluntarily for the duration of your use of the portal unless you delete these data. You can manage and amend all data provided in the password-protected customer area.

(3) When you use the portal, your data may be made accessible to other users of the portal in accordance with the contractual service. Users who are not registered members will not receive any information about you. Your [username and photo] are visible to all registered members irrespective of whether you have chosen to share them. Your entire profile containing the data that you have chosen to share, on the other hand, is visible to all members whom you have confirmed as personal contacts. If you provide your personal contacts with access to content that you do not send via a private message, this content can be viewed by third parties if your personal contact decides to share it. If you publish posts in public groups, these will be visible to all registered members using the portal.

(4) The connection to the portal is encrypted using SSL technology in order to prevent unauthorised access to your personal data, especially financial data, by third parties.

  1. Use of our forum

(1) You can read entries in our forum without registering.1 If you want to actively contribute to the forum, you need to register by providing your e-mail address and a password and username of your choice. You are not obligated to use your real name and can therefore choose to use a nickname if desired. If you want to use a portal, you need to register by providing your personal details. When you submit your registration, we use the so-called double opt-in method, meaning that your registration will not be complete until you confirm it by clicking on the corresponding link in the confirmation e-mail that you will receive after submitting your registration. If you do not confirm your registration shortly after receiving the e-mail, it will be automatically deleted from our database.

(2) If you register for a forum account, we will save your username, password and e-mail address, as well as all of the information that you submit and activities that you carry out in the forum, namely public contributions, posts on the wall, friendships, private messages (although we have no access to the content of these messages), etc., in order to run the forum.

(3) If you delete your account, your public comments, especially posts published in the forum will remain visible to all users. Your account, however, will no longer be accessible and will be marked as "[Guest]" in the forum. All other data will be deleted. If you also want your public contributions to be deleted, please contact the service provider using the contact details specified above.

(4) The forum can also be accessed via the [name] mobile app for [iOS/Android/Windows Phone, etc.]. When you install this app, your data will be used by the operator of the app. Your username, password and any private messages will be transferred between the forum and the app, but will not be transferred to the server of the app provider. Use of the app is subject to the data protection regulations of [name and address of and link to the data protection regulations of the app provider].

Module: Newsletter

  1. Newsletter

(1) When you sign up to receive our newsletter, we use the so-called double opt-in method. This means that once you have submitted your e-mail address, we send a confirmation e-mail to the e-mail address provided in which we ask you to confirm that you want to receive the newsletter. If you do not confirm your registration within 24 hours, it will be automatically deleted. If you confirm that you want to receive the newsletter, we will store your e-mail address until you cancel your newsletter registration. We only store your e-mail address for the purpose of sending you the newsletter. When you register and confirm your registration, we also store your IP addresses and the times at which you carry out these activities in order to prevent the misuse of your personal data.

(2) The only information that you are required to provide in order to be sent the newsletter is your e-mail address. [The provision of any other separately marked details is voluntary and will only be used to personalise your newsletter. These data will also be fully deleted. If you cancel your newsletter registration.]

(3) You can withdraw your consent to being sent the newsletter at any time. You can do so by clicking on the link provided in each newsletter e-mail or by sending a message to the contact details specified in the Legal Notice. The details that you provide will not be passed on to third parties.

(4) Please note that your user behaviour is evaluated when we send you the newsletter. In order to carry out this evaluation, the e-mails sent to you contain so-called web beacons, also known as tracking pixels. These are 1x1 pixel image files that link to our website, enabling us to evaluate your user behaviour. We do so by collecting the data specified in Section 4 and using web beacons that are allocated to your e-mail address and connected to your own individual ID. The data collected is always pseudonymised, meaning that the IDs are not linked to your other personal data and thus excluding the possibility of direct identification of individual users. The newsletter provider saves the information collected using this method on its server in [Europe]. You can objected to this tracking at any time by clicking on the separate link provided in each e-mail or contacting us via the details specified in paragraph (3). Such tracking is also not possible if you have deactivated the display of images in your e-mail programme as standard. In this case, you will also, however, not be able to see the newsletter in full and may not be able to use all of its functions. If you manually choose to display the images, the tracking specified above will be activated.

  1. The "Tell a friend" function

(1) We offer you the chance to use the so-called "Tell a friend" function, which enables you to recommend our service to other individuals who you believe may be interested in it. In order to do so, simply enter the e-mail address of the individual concerned in our "Tell a friend" form. You can also choose to add a personal message. We will then automatically send the individual an e-mail on your behalf.

(2) Please note that you are responsible for the e-mail addresses submitted and are deemed to be the responsible body as defined by the German Federal Data Protection Act (BDSG).

(3) When you use this function, we initially save the information that you have requested that a recommendation e-mail be sent, the time at which you submitted your request and the e-mail address of the recipient. We will, however, delete this information at a later point in time. We save these details in order to prevent misuse of the function. The data collected for the function are not used for any other purposes and are stored separately from other data. We additionally have a "blacklist" that is encrypted and separate from other data in which users can specify that they do not want to receive any further messages by clicking on a "block" link in the e-mail sent.

 

 

Module: Webtracking

  1. Use of Google Analytics

(1) This website uses Google Analytics, a web analysis service from the company Google Inc. ("Google"). Google Analytics uses so-called "cookies", i.e. text files that are stored to your computer in order to enable an analysis of your use of the website. The information generated by these cookies about your use of this website is usually transmitted to a Google server in the USA and stored there. If the anonymisation function for IP addresses is activated on this website, Google will, however, abbreviate your IP address before transmitting this information within member states of the European Union or in other contractual states of the Agreement on the European Economic Area. 1) On this website, etracker GmbH (http://www.etracker.com) technologies are used to collect and store data for marketing and optimisation purposes. These data can be used to create pseudonymous use profiles. Cookies may be used to serve this purpose. Cookies are small text files that are locally stored in the cache of the Internet browser of visitors to the web page. They enable the Internet browser to be identified in the case of future visits. Module: Social Media Plug-ins

  1. Use of social media plug-ins

(1) We currently use the following social media plug-ins: [Facebook, Google+, Twitter, Xing, Pinterest, Instagram, T3N, LinkedIn, Flattr]. When doing so, we use the so-called two-click solution. This means that when you visit our page, no personal data are initially disclosed to the providers of these plug-ins. You can identify the provider of a plug-in by looking at the marking in the greyed-out box, which contains the first letter of the provider's name. Your personal data will only be transmitted when you click on one of the plug-ins. When you activate a plug-in, your data will be automatically transmitted to the respective plug-in provider, where it will be stored (in the USA in the case of American providers). We have no influence on the data collected and the data processing methods used and are also unaware of the full extent of the data collection activities, the purposes behind these activities or the storage periods. Given that the plug-in providers particularly use cookies to collect data, we recommend that you use your browser's security settings to delete all cookies before clicking on the greyed-out box.

(2) When you activate a plug-in, the plug-in provider receives the information that you have accessed the corresponding page on our website. The provider also receives the data specified in Section 4 of this Privacy Policy, although in the case of Facebook and Xing, the respective providers state that only an anonymised IP address is recorded in Germany. (1) We have integrated YouTube videos into our website. The videos are stored at www.YouTube.com and can be played directly on our website. (2) When you download the app, the information required for the download is transmitted to the App Store, most importantly the username, e-mail address and customer number of your account, the time of the download, payment information and your device's individual identification number. We do not, however, have any influence on this data collection and take no responsibility for it. If you activate the "No ad-tracking" option under "Data Protection" – "Advertising" in the iOS settings, we can only carry out the following measures: measuring your interaction with banners by counting the number of times a banner is shown without being clicked ("frequency capping"), measuring your click rate, determining your unique use (as a "unique user") and implementing security measures, tackling fraud and correcting errors. You can delete the IDFA in your device settings ("reset ad-ID") at any time and will then be given a new IDFA that will not be linked to the data previously collected.
